Privacy policy

This is what JilbabCo (“we”, “us”, “the atelier”) keeps of yours when you visit this site, open an account, or buy from us — why we keep it, who else sees it, and how you may ask us about it. It is written to be read, not merely agreed to.

1. Who we are

JilbabCo is a Moroccan garment house. Our garments are made in the atelier in the Marrakech medina and sold through this site to customers in Morocco, the United States and elsewhere. For anything in this policy, write to customerservice@jilbabco.com; the atelier’s postal address is on our contact page.

2. What we collect, and when

When you buy. Your name, email, telephone, billing and shipping addresses, what you ordered, and how it was paid. Card numbers never reach us: payment is taken by our payment providers, who tell us only that it succeeded and the last four digits.

When you open an account. Your email and name, your order history, the addresses you save, and — if you choose a made-to-measure garment — the measurements you give us or that the atelier takes for you. Measurements are personal; they are kept for your account alone, used only to cut your garment, and deleted with the account.

When you write to us. Whatever you put in a message, a repair request, a review or a form, and the photographs you send with it.

When you simply visit. The address of your device, the browser and screen you use, the pages you open and how you reached them, and the identifiers set by the cookies described in our cookie notice. Analytics and marketing cookies are set only with your consent where the law asks for it.

3. Why we use it

• to make, pack, ship and, where needed, repair or exchange what you bought, and to write to you about it;
• to run your account, sign you in, and remember your addresses and measurements;
• to answer you when you write, and to keep a record of what was agreed;
• to keep the site, our accounts and our payments safe, and to detect fraud;
• to understand how the site is used so we may improve it — in aggregate, wherever we can;
• with your consent, to send you news of the atelier and its collections, and to show you our garments on other sites; you may withdraw that consent at any time, by the link in every email or by writing to us;
• to meet the obligations the law places on a seller: tax, accounting, consumer protection, and lawful requests from authorities.

Where European or similar law applies, our grounds are the contract we have with you, our legitimate interest in running an honest shop, your consent where we ask for it, and our legal obligations.

4. Who else sees it

We do not sell your personal information, and we do not rent it. It is shared only with those who help us serve you, and only as far as that needs:

• Shopify, which hosts this store, our accounts and our checkout, and processes orders and payments on our behalf — see Shopify’s privacy policy;
• payment providers (Shopify Payments and the wallets offered at checkout), who hold your card details under their own policies;
• carriers, who receive your name, address and telephone to deliver a parcel;
• our own tools: the atelier’s order and measurement system, our email service, the reviews service, and the analytics and advertising tools named in the cookie notice, each of which acts on our instructions or under its own published policy;
• professional advisers and authorities, where the law requires it or a right of ours has to be defended;
• a successor, if the atelier is ever sold or merged, on the same terms as these.

5. Cookies and similar things

The site uses a small number of cookies and similar identifiers: some to keep your cart and sign-in working, some, with your consent, to measure the site and to show you our garments elsewhere. Which they are, what each is for, and how to change your choices at any time is set out plainly in our cookie notice.

6. How long we keep it

Order and payment records are kept for as long as tax and accounting law requires — in general ten years in Morocco, seven in the United States. An account, its addresses and its measurements are kept until you close it, or until it has lain unused for five years. Messages are kept for three years after the last exchange. Analytics data is kept in aggregate; identifiers from cookies last no longer than the cookie notice says.

7. How it is looked after

The store runs on Shopify’s infrastructure, which is encrypted in transit and at rest and certified to the payment industry’s standard. Within the atelier, access to your details is limited to those who need them to serve you. No system is beyond every risk; should a breach ever touch your data, we will tell you, and the authority concerned, without undue delay.

8. Your rights

Wherever you are, you may ask us what we hold about you, ask that it be corrected, ask that it be deleted, ask that it be sent to you in a usable form, object to a use you do not want, and withdraw a consent you gave. Residents of Morocco hold these rights under Law 09-08; residents of the European Economic Area and the United Kingdom under the GDPR; residents of California and other US states under their state privacy laws, including the right to opt out of the sharing of personal information for targeted advertising, which you may exercise on our cookie notice or by writing to us. We will not treat you differently for exercising a right.

Write to customerservice@jilbabco.com. We answer within thirty days, and may ask you to confirm it is you. If you are not content with our answer, you may complain to your data protection authority — in Morocco, the CNDP.

9. Where it travels

Shopify and most of our tools keep data on servers outside Morocco, chiefly in the United States, Canada and the European Union. Where data leaves the place you live, it does so under the safeguards those laws provide — Shopify’s and our providers’ standard contractual clauses, and the certifications they publish.

10. Children

The site is for adults. We do not knowingly collect personal information from anyone under sixteen; a kids’ garment is bought by, and the account belongs to, an adult. If a child has given us something, write to us and we will remove it.

11. Links elsewhere

Where the site links to another — a carrier, a payment wallet, a social network — that site’s policy applies once you are there, not this one.

12. Changes to this policy

When this policy changes, the new version is published here with its date, and a change that matters is announced on the site. The version in force is always the one on this page.

١. من نحن

جلبابكو دار ملابس مغربية. تُصنع ملابسنا في الورشة بمدينة مراكش القديمة وتُباع عبر هذا الموقع لزبائن في المغرب والولايات المتحدة وغيرهما. لأي أمر يخص هذه السياسة، راسلونا على customerservice@jilbabco.com؛ وعنوان الورشة البريدي في صفحة الاتصال.

٢. ما نجمعه، ومتى

حين تشترون. اسمكم وبريدكم الإلكتروني وهاتفكم وعنوانا الفوترة والشحن، وما طلبتموه، وكيف دُفع ثمنه. أرقام البطاقات لا تصل إلينا أبدًا: الدفع يتولاه مزوّدو الدفع، ولا يخبروننا إلا بنجاحه وبالأرقام الأربعة الأخيرة.

حين تفتحون حسابًا. بريدكم واسمكم، وسجل طلباتكم، والعناوين التي تحفظونها، وإن اخترتم ثوبًا على المقاس، المقاسات التي تعطوننا إياها أو التي تأخذها الورشة لكم. المقاسات أمر شخصي: تُحفظ لحسابكم وحده، ولا تُستعمل إلا لقصّ ثوبكم، وتُحذف مع الحساب.

حين تراسلوننا. ما تكتبونه في رسالة أو طلب إصلاح أو تقييم أو استمارة، والصور التي ترسلونها معها.

حين تزورون فحسب. عنوان جهازكم، والمتصفح والشاشة اللذان تستعملونهما، والصفحات التي تفتحونها وكيف وصلتم إليها، والمعرّفات التي تضعها ملفات الارتباط الموصوفة في إشعار ملفات الارتباط. ملفات التحليل والتسويق لا تُوضع إلا بموافقتكم حيث يطلب القانون ذلك.

٣. لماذا نستعملها

• لصنع ما اشتريتموه وتغليفه وشحنه، وإصلاحه أو استبداله عند الحاجة، ومراسلتكم بشأنه؛
• لإدارة حسابكم وتسجيل دخولكم وتذكّر عناوينكم ومقاساتكم؛
• للرد عليكم حين تراسلوننا، وحفظ سجل بما اتُّفق عليه؛
• لحماية الموقع وحساباتنا ومدفوعاتنا، وكشف الاحتيال؛
• لفهم كيف يُستعمل الموقع حتى نحسّنه، بصورة مجمّعة كلما أمكن؛
• بموافقتكم، لإرسال أخبار الورشة ومجموعاتها إليكم، وعرض ملابسنا لكم في مواقع أخرى؛ ويمكنكم سحب هذه الموافقة في أي وقت عبر الرابط في كل رسالة أو بمراسلتنا؛
• للوفاء بما يفرضه القانون على البائع: الضرائب والمحاسبة وحماية المستهلك والطلبات المشروعة من السلطات.

حيث يسري القانون الأوروبي أو ما يماثله، فأسسنا هي العقد الذي بيننا، ومصلحتنا المشروعة في إدارة متجر أمين، وموافقتكم حيث نطلبها، والتزاماتنا القانونية.

٤. من غيرنا يطّلع عليها

لا نبيع معلوماتكم الشخصية ولا نؤجّرها. ولا تُشارَك إلا مع من يعيننا على خدمتكم، وبقدر ما تحتاجه الخدمة:

• شوبيفاي، التي تستضيف هذا المتجر وحساباتنا وصفحة الدفع، وتعالج الطلبات والمدفوعات نيابة عنا — انظروا سياسة خصوصية شوبيفاي؛
• مزوّدو الدفع (Shopify Payments والمحافظ المعروضة عند الدفع)، الذين يحتفظون ببيانات بطاقتكم وفق سياساتهم؛
• شركات النقل، التي تتلقى اسمكم وعنوانكم وهاتفكم لتسليم الطرد؛
• أدواتنا: نظام الطلبات والمقاسات في الورشة، وخدمة البريد، وخدمة التقييمات، وأدوات التحليل والإعلان المسمّاة في إشعار ملفات الارتباط، وكلٌّ منها يعمل بتعليماتنا أو وفق سياسته المنشورة؛
• المستشارون المهنيون والسلطات، حيث يقتضي القانون ذلك أو يلزم الدفاع عن حق لنا؛
• خلفٌ لنا، إن بيعت الورشة يومًا أو اندمجت، بالشروط نفسها.

٥. ملفات الارتباط وما يشبهها

يستعمل الموقع عددًا قليلًا من ملفات الارتباط والمعرّفات المشابهة: بعضها ليبقى سلّتكم وتسجيل دخولكم يعملان، وبعضها، بموافقتكم، لقياس الموقع وعرض ملابسنا لكم في مواقع أخرى. ما هي، وما غرض كلٍّ منها، وكيف تغيّرون اختياراتكم في أي وقت، مبيّن بوضوح في إشعار ملفات الارتباط.

٦. كم نحتفظ بها

تُحفظ سجلات الطلبات والمدفوعات ما دام قانون الضرائب والمحاسبة يقتضيه: عشر سنوات في المغرب عمومًا، وسبع في الولايات المتحدة. ويُحفظ الحساب وعناوينه ومقاساته حتى تغلقوه، أو حتى يمضي عليه خمس سنوات دون استعمال. وتُحفظ الرسائل ثلاث سنوات بعد آخر تبادل. وبيانات التحليل تُحفظ مجمّعة؛ ومعرّفات ملفات الارتباط لا تدوم أكثر مما يذكره إشعار ملفات الارتباط.

٧. كيف نحميها

يعمل المتجر على بنية شوبيفاي، المشفّرة أثناء النقل وفي التخزين والمعتمدة وفق معيار صناعة الدفع. وداخل الورشة، يقتصر الوصول إلى بياناتكم على من يحتاجها لخدمتكم. وما من نظام بمنأى عن كل خطر؛ فإن مسّ خرقٌ بياناتكم يومًا، أخبرناكم وأخبرنا السلطة المعنية دون تأخير لا مبرر له.

٨. حقوقكم

أينما كنتم، يمكنكم أن تسألونا عمّا نحتفظ به عنكم، وأن تطلبوا تصحيحه، أو حذفه، أو إرساله إليكم بصيغة قابلة للاستعمال، وأن تعترضوا على استعمال لا تريدونه، وأن تسحبوا موافقة أعطيتموها. ويحمل المقيمون في المغرب هذه الحقوق بموجب القانون 09-08؛ والمقيمون في المنطقة الاقتصادية الأوروبية والمملكة المتحدة بموجب اللائحة العامة لحماية البيانات؛ والمقيمون في كاليفورنيا وولايات أمريكية أخرى بموجب قوانين الخصوصية في ولاياتهم، بما فيها الحق في رفض مشاركة المعلومات الشخصية للإعلان الموجّه، وهو ما يمكنكم ممارسته في إشعار ملفات الارتباط أو بمراسلتنا. ولن نعاملكم معاملة مختلفة لممارستكم حقًّا.

راسلونا على customerservice@jilbabco.com. نجيب خلال ثلاثين يومًا، وقد نطلب منكم تأكيد هويتكم. وإن لم يرضكم جوابنا، فلكم أن تشتكوا إلى سلطة حماية البيانات لديكم، وهي في المغرب اللجنة الوطنية لمراقبة حماية المعطيات ذات الطابع الشخصي.

٩. إلى أين تسافر

تحتفظ شوبيفاي ومعظم أدواتنا بالبيانات على خوادم خارج المغرب، في الولايات المتحدة وكندا والاتحاد الأوروبي أساسًا. وحين تغادر البيانات المكان الذي تعيشون فيه، فإنها تفعل ذلك وفق الضمانات التي توفرها تلك القوانين: البنود التعاقدية النموذجية لدى شوبيفاي ومزوّدينا، والشهادات التي ينشرونها.

١٠. الأطفال

الموقع للبالغين. لا نجمع عن علم معلومات شخصية من أي شخص دون السادسة عشرة؛ فثوب الطفل يشتريه بالغ، والحساب يخصّ بالغًا. وإن أعطانا طفل شيئًا، فراسلونا ونزيله.

١١. روابط إلى مواقع أخرى

حين يحيل الموقع إلى موقع آخر، كشركة نقل أو محفظة دفع أو شبكة اجتماعية، فسياسة ذلك الموقع هي التي تسري ما إن تصلوا إليه، لا هذه.

١٢. التغييرات على هذه السياسة

حين تتغير هذه السياسة، تُنشر النسخة الجديدة هنا بتاريخها، ويُعلَن عن أي تغيير مهم على الموقع. والنسخة السارية هي دائمًا ما في هذه الصفحة.
